• Contact details: Name, phone number, WhatsApp number, and email address provided via our contact form or directly through communication.
• Business information: Your business name, industry, advertising goals, and budget, shared as part of onboarding or enquiries.
• Ad account access: Where you engage us for Meta Ads management, you may grant us access to your Facebook/Meta Business Manager and ad accounts. We access these solely to perform the agreed services.
• Payment information: We do not store payment card details. Payments are processed through third-party payment gateways and are subject to their privacy policies.
• Website usage data: We may collect anonymised analytics data (pages visited, time on site) through tools such as Google Analytics.

1.2 How We Use Your Information

• To respond to your enquiries and provide our services.
• To manage and optimise your Meta Ads campaigns.
• To send service updates, invoices, and reports relevant to your engagement.
• To send promotional communications, with your consent, which you may opt out of at any time.
• To comply with applicable legal and regulatory requirements.

1.3 Sharing of Information

We do not sell, rent, or share your personal data with third parties except in the following limited circumstances:

• With Meta Platforms, Inc. and Google LLC when required for the delivery of advertising or analytics services.
• With payment processors to facilitate transactions.
• When required by law, court order, or regulatory authority.

1.4 Data Retention

We retain your personal data for as long as necessary to provide our services and fulfil our legal obligations. Upon termination of a service agreement, we will securely delete or anonymise your data within 90 days, unless a longer retention period is required by law.

1.5 Security

We implement reasonable technical and organisational measures to protect your data against unauthorised access, loss, or misuse. However, no method of internet transmission is completely secure, and we cannot guarantee absolute security.

1.6 Your Rights

2. Terms of Service

By engaging Smart Design Studio for any service — including Meta Ads management, graphic design, or training — you agree to the following terms.

2.1 Services

Smart Design Studio provides Meta Ads management, graphic design, and practical Meta Ads training services to small and medium-sized businesses. The specific scope of services will be agreed upon in writing (via email, WhatsApp, or a formal proposal) prior to commencement.

2.2 Client Responsibilities

• Providing accurate business information and timely access to necessary accounts (e.g., Meta Business Manager, ad accounts, Facebook Pages).
• Ensuring that your business and its advertising comply with Meta's Advertising Policies and applicable Indian laws, including the Consumer Protection Act and IT Act.
• Providing feedback on creative assets within the agreed timeline. Delays in feedback may affect campaign performance and timelines.
• Maintaining adequate ad budget in your Meta account to run campaigns as planned.

2.3 Ad Spend

Ad spend paid to Meta is separate from our service fees. Smart Design Studio does not handle or hold client ad budgets; these are paid directly by the client to Meta. We are not liable for any changes in Meta's pricing, policies, or platform behaviour.

2.4 Results Disclaimer

While we strive to deliver the best possible results, we cannot guarantee specific outcomes from advertising campaigns (e.g., a specific number of leads, sales, or ROAS). Advertising results depend on factors outside our control including market conditions, your product or service quality, competition, and Meta's algorithm changes.

2.5 Intellectual Property

All creative assets designed by Smart Design Studio remain our property until payment is received in full. Upon full payment, intellectual property rights for custom design work transfer to the client, except for any proprietary templates, elements, or tools developed by us, which remain our property.

2.6 Confidentiality

We treat all client information as strictly confidential. We will not disclose your business strategies, data, or results to third parties without your consent, except as required by law.

2.7 Termination

Either party may terminate a service agreement with 30 days' written notice. Upon termination, we will hand over all assets, login credentials, and account access belonging to the client. Outstanding fees for work completed prior to termination remain payable.

2.8 Limitation of Liability

To the maximum extent permitted by law, Smart Design Studio's total liability to you for any claim arising from our services shall not exceed the total fees paid to us in the three months preceding the claim. We are not liable for indirect, consequential, or incidental damages.

2.9 Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Kolkata, West Bengal.

3. Refund & Cancellation Policy

3.1 Meta Ads Management Services

• Setup fees: Non-refundable once campaign setup has commenced.
• Monthly retainers: If you cancel within the first 7 days of a billing cycle, we will refund a prorated amount for the unused period. Cancellations after 7 days of the billing cycle are not eligible for a refund for that cycle.
• Minimum notice for cancellation is 30 days in writing.

3.2 Graphic Design Services

• Deposits paid to commence a design project are non-refundable.
• If a project is cancelled by the client after work has begun but before delivery, fees for work completed will be charged and any remaining balance from an advance will be refunded.
• Once final files have been delivered and approved, no refund is applicable.

3.3 Training Programs

• Training fee cancellations made 7 or more days before the scheduled training date are eligible for a full refund or credit toward a future session.
• Cancellations within 7 days of the training date are not eligible for a refund but may be transferred to another participant or rescheduled once.
• No refund for no-shows.

3.4 How to Request a Refund

Email us at info@smartdesignsstudio.com with your name, service details, and reason for the request. Eligible refunds will be processed within 10–15 business days via the original payment method.

3.5 Ad Spend

We have no control over ad spend paid directly to Meta. Refund requests for ad spend must be directed to Meta Platforms, Inc. and are subject to their policies.

4. Disclaimer

4.1 No Guarantee of Results

All advertising, design, and marketing services provided by Smart Design Studio are performed with professional diligence and expertise. However, no guarantee of specific results, revenue, leads, sales, or return on investment is made or implied. The performance of advertising campaigns is subject to numerous variables including — but not limited to — market conditions, consumer behaviour, competition, Meta platform changes, and the quality of the client's own product or service.

4.2 Third-Party Platforms

Smart Design Studio operates on and with third-party platforms including Meta (Facebook & Instagram), Google, WhatsApp, and others. We are not affiliated with, endorsed by, or officially partnered with Meta Platforms, Inc. or any other third-party platform unless explicitly stated. Platform policies, features, and pricing are subject to change and are outside our control.

4.3 Training Content

Training content is based on our practical experience and publicly available information. It is provided for educational purposes and reflects platform features and best practices at the time of delivery. As Meta's platform evolves frequently, we recommend verifying information with Meta's official Business Help Centre.

4.4 Website Content
